Compass Digital PR
Terms of Service & Privacy Policy
Section 1 — Terms of Service
Who We Are
Compass Digital PR is a digital marketing service operated by Marcus Alvarez, a sole proprietor based in Puerto Rico. We provide digital marketing, automation, and visibility services exclusively to hospitality businesses in Puerto Rico.
What We Offer
Services include but are not limited to Guest Dock — a guest capture, review automation, and email nurture system — as well as website development, Google Business Profile optimization, and Google Ads management. The specific scope of services for each client is agreed upon before work begins.
Eligibility
Our services are intended for individuals who are 18 years of age or older and have the legal capacity to enter into a binding agreement. By engaging our services, you confirm that you meet these requirements and are authorized to enter into this agreement on behalf of yourself or your business.
Payment
Payment terms are confirmed in writing before any work starts. Setup fees are due before the engagement begins. Monthly retainers are invoiced at the start of each billing period. All fees are stated in US dollars.
Cancellation
You can cancel at any time with no penalties and no contracts. Upon cancellation, all guest data belonging to you is exported and delivered within 5 business days. The system is deactivated upon cancellation. All accounts and assets built inside your own platforms remain yours permanently.
Your Data and Assets
Everything built inside your accounts — your Google Business Profile, your website, your guest database, your booking forms — belongs to you. Compass Digital PR acts as a service provider and data processor only. We do not claim ownership over any client asset or guest data.
No Guarantee of Results
Digital marketing results depend on many factors outside our control, including your property’s location, market conditions, staff compliance, platform algorithm changes, and the quality of your product or service. Compass Digital PR does not guarantee specific outcomes including but not limited to a specific number of bookings, a specific increase in revenue, or a specific search ranking. Past results from other clients are shared for illustrative purposes only and are not a guarantee of your results. Any projections or estimates we provide are based on reasonable assumptions and are not promises.
Prohibited Uses
By engaging our services, you agree not to misrepresent our work as your own, resell or sublicense any deliverable we produce without written consent, use our services for any unlawful purpose, or interfere with our ability to serve other clients.
Feedback and Testimonials
If you provide feedback, a testimonial, a review, or case study participation about our services, you grant Compass Digital PR the right to use that content for marketing and business development purposes. We will always ask before using your name or business name publicly.
Indemnification
You agree to hold Compass Digital PR and Marcus Alvarez harmless from any claims, damages, losses, or expenses — including reasonable legal fees — arising from your use of our services, your violation of these terms, or any claims made by third parties in connection with your business operations.
Limitation of Liability
Compass Digital PR is not liable for indirect, incidental, or consequential damages arising from the use of our services. Our total liability in any dispute is limited to the amount paid by the client in the 30 days preceding the claim.
Force Majeure
Compass Digital PR will not be held responsible for delays or failure to deliver services caused by circumstances beyond our reasonable control. This includes but is not limited to hurricanes, tropical storms, extended power outages, flooding, earthquakes, other natural disasters, internet or platform outages, government actions, pandemics, or any other event that makes performance impossible or impractical. In the event of a force majeure situation, we will notify you as soon as reasonably possible and resume services when conditions allow. No penalties, refunds, or breach claims will apply during a verified force majeure period.
Survival
The following sections remain in effect after this agreement ends for any reason: No Guarantee of Results, Indemnification, Limitation of Liability, Feedback and Testimonials, and Governing Law.
Changes to These Terms
We may update these terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. Clients will be notified of material changes via their dedicated Slack channel or email.
Governing Law
These terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States.
